An owner wishes to grant a second bank a mortgage over the same registered property already mortgaged to a first bank. The first mortgage does not prohibit the proposed second mortgage, and all other required approvals and formalities can be met. The owner is told that land can support only one mortgage at a time. Which response is correct?
Section 72 expressly contemplates registration of a subsequent mortgage not prohibited by the prior mortgage's terms. Thus the same land can support more than one mortgage; a first mortgage is not an exclusive allocation of the property's entire capacity to serve as collateral. Section 68(3) also distinguishes mortgage security from a transfer of the land. The facts remove approval and formalities obstacles. This question tests coexistence of security interests, not how they rank or how proceeds would be distributed.
